1. Data controller

The personal data collected through agely.care is processed by AGELY, 60 rue François Ier, 75008 Paris, France, registered with the RCS Paris under number 992 097 360.

Data protection contact: dpo@agely.care

2. Processing, purposes and legal bases

2.1 Forms

When you fill in a form (sign-up, demo request, deployment request, contact), we collect the data you enter: email address and, depending on the form, first name, last name, phone number, role, organisation, job title and message, together with the language of the page and the campaign that brought you to the site (utm parameters, Meta click identifier). We use them to answer your request and to follow up with you about Agely.

Legal bases: steps taken at your request before a contract (Article 6(1)(b) GDPR) and our legitimate interest in following up with people who contacted us (Article 6(1)(f) GDPR).

The email address is required to answer you. Without it, the form cannot be sent.

2.2 Protection against spam

Our forms are protected by Google reCAPTCHA v3, which analyses your interaction with the page to tell people from bots. Legal basis: our legitimate interest in protecting the site and our services (Article 6(1)(f) GDPR).

2.3 Security logs

Our server records each form submission (date, email address, form, language, anti-spam result) to secure the service and keep proof of requests. Legal basis: our legitimate interest (Article 6(1)(f) GDPR).

2.4 Audience measurement and advertising

With your consent only, Google Tag Manager loads Google Analytics 4 (audience measurement), Microsoft Clarity (how pages are used) and the Meta Pixel with its server-side counterpart, the Meta Conversions API (measuring our advertising campaigns). Legal basis: your consent (Article 6(1)(a) GDPR), which you can withdraw at any time as described in section 6.

3. Cookies and local storage

  • Consent choice (stored in your browser): remembers whether you accepted or declined. Kept until you clear the site data.
  • Language (cookie lang): remembers the language you chose. Kept 1 year.
  • Campaign origin (stored in your browser): keeps the utm parameters and the Meta click identifier of your visit, with two random event identifiers that let an advertising platform count a form submission once, so that a form can carry them. Stored only if you accept; without your consent it stays on the open page and is never saved. Kept 7 days, and deleted if you decline or withdraw your consent.
  • Google Analytics, Microsoft Clarity, Meta Pixel: set only if you accept.
  • Google reCAPTCHA: needed to secure the forms.

4. Recipients

Your data is accessible to the Agely team and to the following service providers, within their role:

  • Brevo (France): contact database and emails, including the internal alert that notifies our team of each request.
  • OVHcloud (France): website hosting.
  • Google (reCAPTCHA, Google Tag Manager, Google Analytics 4).
  • Microsoft (Clarity).
  • Meta (Pixel and Conversions API). For the Pixel, Meta acts as a joint controller with us.

5. Transfers outside the European Union

Google, Microsoft and Meta may transfer data to the United States. These transfers rely on the European Commission adequacy decision of 10 July 2023 on the EU-US Data Privacy Framework, under which these companies are certified.

6. Retention periods

  • Form data: 3 years from your last contact with us.
  • Security logs: 12 months.
  • Audience measurement data: 14 months at most.
  • Data collected by the Meta Pixel: kept by Meta under its own data policy.
  • Cookies and local storage: see section 3.

To withdraw or change your consent at any time, use the "Cookie settings" link at the bottom of every page.

7. Your rights

You have the right to access, rectify and erase your data, to restrict its processing, to object to it, to data portability, to withdraw your consent at any time, and to give instructions on what happens to your data after your death. To exercise them, write to dpo@agely.care.

You may also lodge a complaint with the CNIL (Commission nationale de l'informatique et des libertés, www.cnil.fr).
